One reason for mediating is that unlike the court process, a mediation can take place at any time. Court proceedings have become very expensive and drawn out.The courts don't have enough judges and this causes serious delays in matters being heard.Sometimes parties have to wait a year or two to get a hearing. This is unfortunate as parties have to put their lives on hold while they wait for a trial. Meanwhile life is speeding past as it always does.Mediation can avoid these delays. I often think, why would parties in their right mind go to court if they have the opportunity to mediate?
