Thursday Thoughts : How can lawyers help with mediation?

Page and Plant, Coffee and cake, Ice and a Slice - some things just go well together don't they? But lawyers and mediation? In this week's "Thursday Thoughts" Mike Emerson, Mediator, Family Lawyer and Co-founder of Brisbane Mediations shares his tips on how lawyers can assist in achieving an outcome at mediation.

  •  Be committed to the process. If you are not motivated to achieve a resolution, do your client a favour and refer them to someone who is.

  • Reality test your client and manage their expectations. Proper preparation and competent advice can guide a client to a realistic expectation and outcome.

  • Stay calm and model conciliatory behaviour in the negotiation. Be persistent in keeping the communication open.

  • Check your client understands and is comfortable with the process. Remember that it is all about the client, not about you.
